These Terms of Service govern your access to and use of the Healthcare with AI platform and services. Please read them carefully.

1. Acceptance of Terms
By creating an account, accessing, or using the Healthcare with AI platform ("Platform") and any related services (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you (whether an individual or an entity) and Healthcare with AI ("Company," "we," "us," or "our").
If you are accepting these Terms on behalf of a healthcare facility, clinic, hospital, or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you must not access or use the Platform.
2. Services Description
Healthcare with AI provides a cloud-based Software-as-a-Service (SaaS) platform for healthcare providers, including but not limited to:
- Electronic Medical Records (EMR) and practice management
- AI-powered WhatsApp patient communication and appointment booking
- Voice AI for automated patient interactions
- Digital prescription generation and management
- Billing, invoicing, and payment processing
- ABDM (Ayushman Bharat Digital Mission) integration and ABHA services
- Analytics and reporting dashboards
- Pharmacy and pathology management modules
2.1 Service Availability
We strive to maintain 99.9% uptime for our Platform. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice.
2.2 Subscription Plans
Access to the Platform is provided through subscription plans with varying features and pricing tiers. Details of current plans are available on our Pricing page. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are subject to our refund policy detailed in the subscription agreement.
3. Account Registration
To use the Platform, you must create an account and complete our onboarding process. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your login credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to verify your identity and professional credentials before granting full access to the Platform, especially for features involving patient data and prescription management.
4. Acceptable Use
You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations. You shall not:
- Use the Platform for any unlawful, fraudulent, or malicious purpose
- Share, sell, or transfer your account access to unauthorized persons
- Attempt to gain unauthorized access to other accounts, systems, or data
- Reverse engineer, decompile, or disassemble any part of the Platform
- Upload or transmit viruses, malware, or any code designed to disrupt the Platform
- Use the Platform to store or process data that you do not have the right to collect or process
- Violate patient privacy or healthcare data regulations in your jurisdiction
- Use AI-generated content (prescriptions, suggestions) without appropriate clinical review and professional judgment
5. Data & Privacy
5.1 Data Ownership
You retain full ownership of all data you input into the Platform, including patient records, clinical data, and business information. We do not claim ownership of your data. We process your data solely to provide and improve the Services as described in our Privacy Policy and Data Processing Agreement.
5.2 Data Portability
You may export your data at any time through the Platform's export features. Upon termination of your subscription, we will provide a 30-day grace period to export your data. After this period, data may be deleted in accordance with our data retention policy.
5.3 Healthcare Data Compliance
You acknowledge that as a healthcare provider, you are responsible for ensuring that your use of the Platform complies with all applicable healthcare regulations, including but not limited to the DPDP Act, Clinical Establishments Act, Indian Medical Council regulations, and ABDM guidelines. You must obtain appropriate patient consent before entering their data into the Platform.
5.4 Medical Disclaimer
Important: The Platform is a technology tool designed to assist healthcare providers. It does not provide medical advice, diagnosis, or treatment. AI-generated suggestions (including prescription recommendations, diagnostic hints, and treatment suggestions) are intended as decision-support tools only and must be reviewed, validated, and approved by a qualified healthcare professional before any clinical action is taken. The Company is not liable for any clinical decisions made based on AI-generated content.
6. Intellectual Property
The Platform, including all software, algorithms, AI models, user interfaces, designs, trademarks, logos, and documentation, is the exclusive intellectual property of Healthcare with AI and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform during your active subscription period, solely for your internal business purposes in providing healthcare services.
You may not copy, modify, distribute, sell, or lease any part of the Platform, nor may you create derivative works based on the Platform without our express written consent.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement
- We do not warrant that the Platform will be error-free, uninterrupted, or free of viruses or other harmful components
- Our total aggregate liability arising from or related to these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill
- We are not liable for any clinical outcomes, medical decisions, or patient harm arising from the use of AI-generated content or any features of the Platform
8. Termination
Either party may terminate these Terms as follows:
- By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
- By Us: We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees after a 15-day grace period.
- Effect of Termination: Upon termination, your right to use the Platform ceases immediately. You will have 30 days to export your data. We may retain anonymized, aggregated data for analytics purposes.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice on the Platform at least 30 days before they take effect.
Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and cancel your subscription.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. Before initiating any legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of 30 days.
